1. Who we are

This site is operated by Everyday Legal Solutions (“ELS”, “we”, “us”), based in Observatory, Cape Town, South Africa. We are the “responsible party” under the Protection of Personal Information Act 4 of 2013 (POPIA).

2. Information we collect

• Information you give us: your name, email address and any details you provide when you contact us or place an order.
• Legal Health Check: your answers are processed in your browser to show your results. They are not sent to us or stored.
• Order information: the documents you buy, your order number, date, billing details and amount paid. Payments are processed by Payfast. We do not see or store your card details.
• Technical information: your IP address, browser and device type, and pages visited, recorded by our web host.

3. Why we use it

• To process orders and give you access to your downloads
• To respond to your queries and provide support
• To meet our legal, tax and record-keeping obligations
• To keep the site secure and improve it
• To send you marketing, only if you have opted in

POPIA permits processing where it is necessary to perform a contract with you, to comply with a legal obligation, where you have consented, or where it serves a legitimate interest that doesn’t override your rights.

4. Marketing

We only send marketing emails if you’ve opted in. Every message includes a way to unsubscribe, and you can withdraw consent at any time.

5. Who we share it with

We use trusted service providers (“operators”) who process information on our instructions and must keep it secure:

• Payfast: payment processing
• Our web host: hosting the website and our online shop, which stores order records
• Our email delivery service: order confirmations and replies to your messages

We do not sell your personal information. We may disclose information where the law requires it.

6. Transfers outside South Africa

Some of our providers store or process information outside South Africa. Where that happens, we take reasonable steps to ensure the recipient is subject to protection comparable to POPIA, as POPIA requires for cross-border transfers.

7. How long we keep it

We keep personal information only as long as necessary for the purposes above or as required by law. Order and payment records are kept for as long as tax law requires us to keep them.

8. Security

We use reasonable technical and organisational measures to protect your information. For example, document download links are tied to your order and expire after 7 days. If a security compromise affects your information, we will notify you and the Information Regulator as the law requires.

9. Your rights

You may ask us to confirm what information we hold about you, to access it, to correct it, to delete it where the law allows, or to stop processing it. You may also withdraw consent you have given. Contact our Information Officer at the details above.

If you’re unhappy with how we’ve handled your information, you may complain to the Information Regulator (South Africa): inforegulator.org.za.

10. Cookies

Our shop uses essential cookies to keep your cart and checkout working. They don’t track you across other sites.

11. Children

Our services are for adults and businesses. We do not knowingly collect personal information from anyone under 18.

We may update this policy. The current version, with its effective date, is always on this page.
